1. Seller and scope
These General Terms and Conditions of Sale govern purchases made on the Omega Smart Store website, operated by Omega Smart Store. The seller’s full legal identity and contact details are set out in the Legal notice.
The customer can save or print these terms before ordering. By confirming an order, the customer accepts the version available on the date of purchase. Specific written conditions agreed with a business customer prevail only for the transaction concerned.
2. Products and prices
The essential characteristics, availability and warranty information for each product are presented before purchase. Photographs are illustrative, but Omega Smart Store must deliver a product that conforms to its description. Used, refurbished or repaired products are identified clearly.
Prices are shown in CFA francs (XAF), including applicable taxes and excluding delivery charges. Delivery charges and the final total are displayed before confirmation. The price charged is the price accepted by the customer when the order is validated.
3. Order and confirmation
The customer selects the products, provides delivery information, chooses an available payment method, checks the order summary and corrects any input error before confirming. The final validation expresses acceptance of the order and these terms.
Omega Smart Store sends an electronic acknowledgement and the order reference. In accordance with Cameroonian electronic-commerce law, acknowledgement is provided online within no more than five days. An order may be cancelled if the product is unavailable, the payment is not confirmed, or there is objective evidence of fraud; any amount already received is then refunded.
4. Payment
Available methods may include MTN Mobile Money, Orange Money, payment on delivery in eligible areas, or an approved instalment plan. The exact conditions, deposit, balance and due dates are shown before confirmation and on the order document.
Customers must never disclose their Mobile Money secret code to Omega Smart Store, its staff or a delivery agent. Payment is complete only after confirmation by the payment provider. A receipt or equivalent proof is provided for the transaction.
5. Delivery
The delivery area, charge and estimated time are disclosed before ordering. The customer must provide a complete address and a reachable telephone number, then inspect the parcel on receipt and report any visible damage or missing item promptly.
If an available product cannot be delivered as agreed, the customer is informed and may obtain cancellation and reimbursement of amounts paid, without prejudice to any other remedy provided by law. A delay caused by force majeure is handled in good faith and communicated without delay.
6. Withdrawal, returns and refunds
The withdrawal request may be sent electronically or by any other relevant means that provides proof. Return instructions and the return address are then communicated by customer service. Unless the return results from non-conformity or an error by Omega Smart Store, direct return costs are borne by the customer.
The product must be returned complete and without alteration beyond what is necessary to inspect it. Statutory exceptions apply in particular to personalised or rapidly perishable goods, services fully performed at the customer’s request before the period expires, and unsealed audio, video or software products.
15-day withdrawal period
For an eligible online purchase, the customer may withdraw within 15 days from the day after receiving the goods. Amounts received are refunded within 15 days after the goods are returned or the service is relinquished, subject to the statutory conditions.
7. Warranties and after-sales service
Products must meet minimum requirements of durability, use and reliability. The receipt and available technical, operating and warranty information accompany the durable product. Manufacturer or commercial warranties supplement, but do not replace, statutory consumer rights.
For a defective or non-conforming product, the customer may request the remedies provided by law, including repair, replacement, cancellation or compensation depending on the circumstances. Omega Smart Store provides after-sales support for durable goods and does not exclude liability through an unfair term.
8. Credit and instalment payments
Before a consumer credit commitment, the cash price, interest amount and annual rate, late-interest rate, number and frequency of instalments, and total amount payable are disclosed in writing. Approval may depend on an eligibility assessment and the conditions of the finance partner.
Where the purchase is financed by credit granted by the seller or a linked third party, valid withdrawal from the purchase terminates the associated credit without penalty under the conditions provided by law.
9. Liability, complaints and disputes
Nothing in these terms limits a mandatory consumer right or excludes liability for defects, deficiencies or non-conformity. The customer should first contact customer service with the order reference and supporting evidence so that an amicable solution can be sought.
These terms are governed by Cameroonian law. If an amicable solution cannot be reached, either party may refer the matter to the competent consumer-recourse body or court in accordance with the applicable rules. The French and English versions are intended to be read together; mandatory law prevails in case of inconsistency.
